Description

British New York Vice-Admiralty Court.

Captured ship: Fox (master Abel Coffin).

Capture history: an American merchant ship (schooner, 118 tons, 14 men) bound from Newburyport, Massachusetts to Philadelphia, Pennsylvania, laden with rum, dry goods, salt, lumber; taken on 25 November 1781 in latitude 38°N off the Capes of Chesapeake about 18 leagues eastward of Cape Henlopen by HMS Centurion (Samuel Wittewrong Clayton commanding), and brought into New York.

Intended voyage: within the United States.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by the prize master John Fitzgerald second lieutenant of HMS Centurion, 5 December 1781;
  • [CP 2]: libel in Advocate General at the relation Clayton v The schooner Fox and her cargo, 5 December 1781;
  • [CP 3]: monition, 5 December 1781;
  • [CP 4]: deposition of Abel Coffin, of Newbury, Massachusetts, 9 December 1781.

[Decision: condemned, if no response to the monition by 25 December 1781].

Ship's Papers numbered SP 1-6 (Massachusetts papers):-

  • SP 1: clearance bond, 11 June 1781;
  • SP 2: crew list and agreement;
  • SP 3-SP 4: business letter from Nathaniel & John Gray, Newburyport, to Isaac Wharton, merchant, Philadelphia, enclosing invoice of cargo, 18 November 1781;
  • SP 5: bill of lading;
  • SP 6: letter from Nathaniel & John Gray, Newburyport, to Isaac Wharton, to pay Abel Coffin, 19 November 1781.

[Papers previously wrongly identified as Court papers: 1-4; Ship's papers: 5-12 (large pencil numbers): one letter moved to HCA 32/334/3. All sorted and renumbered in 2025].
