Description

British New York Vice-Admiralty Court.

Captured ship: L'Espérance (master Samuel Young, but under the command of Augustine Causton when captured).

History: a French merchant ship (brigantine, 100 tons) bound from Philadelphia to Martinique, laden with flour, bread, hoops and empty hogsheads; taken on 16 March 1777 off Cape May by HMS Preston (Samuel Uppleby commanding), and brought into [New York].

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by Uppleby, 17 September 1777;
  • [CP 2]: libel in Advocate General at the relation of Uppleby v The brigantine L'Espérance, 22 September 1777;
  • [CP 3]: deposition of Samuel Young, painter and dyer, and Peter Walsh hosier or mariner, 1 October 1777;
  • [CP 4]: deposition of David Miller mariner, 1 October 1777;
  • [CP 5]: account of expenses due to Henry White, for use of the brig Espérance, for pilotage, for an interpreter etc, 19 March -June 19 1778.

Ship's Papers [a master's archive] numbered SP 1-8 (Pennsylvania papers):-

  • SP 1: clearance from Philadelphia;
  • SP 2: French pass for a previous ship La Demoiselle to trade in the French West Indian islands, 1775;
  • SP 3: French pass issued in Martinique for Samuel Young of Ireland, 1771;
  • SP 4-SP 8: crew lists and agreements for five previous voyages in three different ships, 1774-1776.

[Papers previously wrongly identified as Court papers: 1-5; Ship's papers: 6-12 (large pencil numbers): sorted and renumbered in 2025. CP 5 added here from HCA 49/91 in 2025, but may be misplaced].
