Description

British New York Vice-Admiralty Court.

Captured ship: Elizabeth and Nancy (master Paul Marie Liautaud).

History: a French merchant ship (brigantine, 150 tons) bound from Cap François, Saint Domingue to Philadelphia, Pennsylvania, laden with sugar, rum; taken on 3 May 1781 in latitude 38°30'N, longitude 24°30'W [off the Azores] by the loyalist privateer General Arnold (William Neilson commanding), and brought into [New York].

Court papers numbered CP 1-4:-

  • [CP 1]: libel in Neilson v The brigantine Elizabeth and Nancy and her cargo [incomplete];
  • [CP 2]: affidavit of papers brought in by Neilson [incomplete];
  • [CP 3]: monition, 9 May 1781;
  • [CP 4]: another court paper, very damaged.

[Decision: condemned, if no response to the monition by 30 May 1781].

Ship's Papers numbered SP 1-38:-

  • SP 1: ship's pass from Cap François to the American Sea, 27 February 1781;
  • SP 2: muster roll;
  • SP 3-SP 25: bills of lading from Cap François to Philadelphia, Pennsylvania;
  • SP 26-SP 27: cargo manifest;
  • SP 28-SP 29: two factures;
  • SP 30: owners instructions of Joseph Cassarrouy;
  • SP 31-SP 34: factures, accounts;
  • SP 35: notarised statement;
  • SP 36: business letter from Cassarrouy to Masson, Chauveau & Co, Philadelphia, 12 March 1781;
  • SP 37: letter, from Dupuy [Dera.... ] to 'mon ami', le Cap, 19 February 1781;
  • SP 38: letter from Chauvreau, Phildalphia, to M Mosuet, Port au Prince, 21 April 1781 [this letter must be misplaced].

[Papers previously wrongly identified as Court papers: 1-7; Ship's papers: 8-46 (large pencil numbers): sorted and renumbered in 2025; a fragment added from HCA 32/327/3A in 2025].
