Description

British New York Vice-Admiralty Court.

Captured ship: L'Elegante (master Collineau).

History: an American merchant ship (snow, 150 tons, abandoned by her crew), laden with tobacco; taken on 6 January 1778 at Carters Creek, Rappahannock River, Virginia by HMS Richmond (John Lewis Gidoin commanding), HMS Emerald (Benjamin Caldwell commanding), and brought into New York.

Court papers numbered CP 1-6 renumber :-

  • [CP 1]: affidavit of papers brought in by the prize master John Dart, mate of HMS Emerald, 28 January 1778;
  • [CP 2]: libel in Advocate General at the relation of and cargo, Gidoin and Caldwell v The snow Elegante, 28 January 1778;
  • [CP 3]: standing interrogatories;
  • [CP 4-CP 5]: depositions of John Miller and William Gellan of HMS Emerald, 18 February 1778;
  • [CP 6]: release of interest of Miller and Gellan, 18 February 1778.

Ship's Papers numbered SP 1:-

  • SP 1: facture for tobacco,at 'quars cris' or 'Castes Cris' [Carters Creek?] 6 January 1778.
