Description

High Court of Admiralty.

Captured ship: Effingham (master John Drew).

Capture history: an American loyalist merchant ship with both British and American colours (brigantine, 140 tons, 8 men -7 English, 1 Irish) bound from Charleston, South Carolina to Bordeaux or Nantes, laden with rice, tobacco, indigo, staves; taken on 15 May 1777 in the Bay of Biscay about 80 leagues SW of Isles of Scilly by HMS Valiant (John Leveson Gower commanding), and brought into Portsmouth.

Intended voyage: from the United States to France.

Court papers numbered CP 1-3:-

  • [CP 1]: standing interrogatories, three depositions of John Drew of Waterford, Ireland (deposes that John Morgan the mate was shot by a musket and died after four days; the owner Thomas Shubrick of Charleston is a subject of the King) and Charleston, William Makinzy of London, mariner, William Rascoler of Penryn, Cornwall, cook, commissioners' affidavit, taken at Portsmouth, 31 May 1777;
  • [CP 2]: attestation as to papers (numbered 1-6) brought in by the prize master, John Bluett, masters mate;
  • [CP 3]: allegation.

Ship's Papers numbered SP 1-6 (South Carolina papers):-

  • SP 1: ship's register, Thomas Shubrick owner, 16 September 1776;
  • SP 2: clearance;
  • SP 3: bill of lading, from Charleston to Messsrs Babut & Labouchère, [Nantes], France, 8 March 1777;
  • SP 4-SP 6: invoices of cargo, Thomas Shubrick.

[Papers previously wrongly identified as Court papers: 1-9; Ship's papers: 10-15 (large pencil numbers): sorted and renumbered in 2025].
