Description

British New York Vice-Admiralty Court.

Captured ship: Eagle (master Abner Lowell).

History: an American merchant ship (schooner, 60 tons, 5 men) bound from Newburyport, Massachusetts to Philadelphia, Pennsylvania, laden with salt; taken on 2 November 1778 off Cape May, New Jersey by the loyalist privateer Harriot (William Austin commanding), and brought into New York.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by the prize master William Donaldson, 13 November 1778;
  • [CP 2]: libel in Austin v The schooner Eagle, 13 November 1778;
  • [CP 3]: monition, 13 November 1778;
  • [CP 4]: deposition of Abner Lowell of Newburyport, 19 November 1778.

[Decision: condemned, if no response to the monition by 4 December 1778].

Ship's Papers, including mail in transit, numbered SP 1-7 (Massachusetts papers):-

  • SP 1-SP 2: official ship's papers;
  • SP 3: crew list and agreement;
  • SP 4: business letter from John Donaldson, Newburyport to Nathaniel Tracy, Philadelphia, 24 October 1778;
  • SP 5: business letter from J Peterson, Newburyport to Captain Lowell, 26 October 17778;
  • SP 6: owner's instructions from Nathaniel Tracy, Newburyport, 24 October 1778;
  • SP 7: personal (phonetic) letter from James Mutre, Newbury, to his friend Mr Tilley in Front Street, Philadelphia; as he is bound on a merchant ship to the West Indies, could Tilley receive the prize money due to him from the prizes taken by the privateer Oliver Cromwell, 26 October 1778
