Description

High Court of Admiralty.

Captured ship: Eagle of Dartmouth (commander [Mowry] Potter).

History: an American privateer (schooner, 100 tons, 4 carriage guns, 3 swivels, 34 men) bound from Dartmouth, [Massachusetts] on a cruise; taken on 30 November 1777 in latitude 38°N, longitude 67°W, about 350 leagues distant from New York by HMS Sphinx (Anthony Hunt commanding), and later sunk.

Court papers numbered CP 1-4:-

  • [CP 1]: attestation (taken in New York before David Mathews, mayor) of Shadrack Winslow, late surgeon, and Dean Burt and Joseph Stanton, late mariners, of the Eagle, that they sailed from Bedford, Massachusetts on 27 September 1777, and were taken on 30 November; 18 December 1777;
  • [CP 2]: attestation as to papers (no papers) by Samuel Cuthbert late master at arms of HMS Sphinx, and that as the prize was very damaged by bad weather, Captain Hunt sank her, [London] 11 April 1778;
  • [CP 3]: two depositions of Samuel Cuthbert and of William Elder, later master gunner of HMS Sphinx, taken in London, 13-14 April 1778;
  • [CP 4]: allegation, 5 May 1778
