Description

British New York Vice-Admiralty Court.

Captured ship: Dolphin of Barnstaple (master Robert Day or George Sutter, American prize master John Reit).

Capture history: a British merchant ship (schooner, 30 tons), bound from Placentia within Newfoundland, laden with rum, molasses and flour; taken in August or September 1778 by the American privateer Harlequin (Charles Hamilton commanding), retaken on 14 September 1778 in the Bay of Boston by HMS Experiment (Sir James Wallace commanding) and HMS Unicorn (John Ford), and brought into New York.

Intended voyage: within North America.

Court papers numbered CP 1-5:-

  • [CP 1-CP 2]: affidavit of papers brought in by the prize master Andrew Lessly, midshipman of HMS Experiment, 21 September 1778, and wrapper;
  • [CP 3]: libel in Advocate General at the relation of Wallace and Ford v The schooner Dolphin and her cargo, 23 September 1778.
  • [CP 4]: answer and claim of Hugh Wallace merchant of New York on behalf of William Saunders of Newfoundland and Roger Sweetman of Wexford, Ireland, merchants, for the ship and cargo, as having sailed within Newfoundland in 1778, laden with rum, molasses and flour (master Robert Day);
  • [CP 5]: replication.

Ship's Papers numbered SP 1-2:-

  • SP 1: Barnstaple register;
  • SP 2: privateer's commission of the Harlequin, 4 August 1778.
