Description

British New York Vice-Admiralty Court.

Captured ship: Charter Street (master Andrew Rodgers).

Capture history: an American merchant ship (brigantine, 95 tons, 7 crew and 4 passengers, formerly a British ship bound from Newfoundland to Dartmouth, England taken by Americans in [1776], brought into Boston and condemned), now bound from St Eustatius to Boston, Massachusetts, laden with salt and rum; taken on 12 May 1777 in latitude 28°57'N, longitude 67°33'W by HMS Falcon (Thomas Windsor commanding), and brought into New York.

Intended voyage: from the Caribbean Islands to the United States.

Court papers numbered CP 1-5:-

  • [CP 1]: affidavit of papers brought in by the prize master Geroge Tripp, lieutenant, 7 November 1777;
  • [CP 2]: libel in Advocate General at the relation of Windsor v The brigantine Charter Street, 10 November 1777;
  • [CP 3]: deposition of Joseph Paine, 8 November 1777;
  • [CP 4]: answer and claim of Thomas White on behalf of the owners, inhabitants of Dartmouth, England, of the Charter Street and her cargo, 5 December 1777;
  • [CP 5]: replication.

Ship's Papers numbered SP 1-3:-

  • SP 1: official ship's paper;
  • SP 2: logbook, for the voyage Boston to St Eustatius and back, 13 March-11 May 1777;
  • SP 3: bill of lading.
