Description

High Court of Admiralty.

Captured ship: Cesar (master Jean Baptiste de la Tounerie).

Capture history: a French merchant ship (220-240 tons, 18 men) bound from the York River, Virginia to St Malo, laden with tobacco; taken on 14 July 1778 in latitude 46°N, longitude 18°W of Paris by HMS Porcupine (William Clement Finch commanding), and brought into Portsmouth.

Intended voyage: from the United States to France.

Court papers numbered CP 1-4:-

  • [CP 1]: attestation as to papers (numbered 1-12) brought in by Finch, 23 July 1778;
  • [CP 2]: standing interrogatories;
  • [CP 3]: three depositions of Jean Baptiste de la Tournerie, René Thomas and Guillaume Trouvaux of St Malo , commissioners' affidavit, and covering letter, taken at Portsmouth, 27 July 1778;
  • [CP 4]: allegation, 5 September 1778;

Ship's Papers numbered SP 1-12:-

  • SP 1: clearance from York River, Virginia, 9 May 1778;
  • SP 2: invoice of tobacco, Messrs Norton & Beale;
  • SP 3: invoice of tobacco, Messrs Carter & Braxton on account of Messrs Norton & Beale;
  • SP 4-SP 5: facture and manifest of tobacco;
  • SP 6: muster roll;
  • SP 7: ship's pass from St Malo to Saint Domingue, 9 December 1777;
  • SP 8-SP 10: official ship's papers, St Malo;
  • SP 11: detailed book or 'templete' of the cargo and trades of the Cesar on behalf of M Duhauteilly for the voyage from St Malo to St Pierre et Miquelon, undated;
  • SP 12: detailed personal letter commenting on American trade and politics from 'Gilbert chirugien' [the ship's surgeon, François Gilbert de Cancalle] at York River, Virginia, to his father [no envelope], 8 June 1778.
