Description

British New York Vice-Admiralty Court.

Captured ship: Badger (American prize master Hezekiah Freeman).

Capture history: a British transport ship for troops taken in September 1779 by the American privateer Defiance of Norwich, Connecticut (Thomas King commanding) and sent in for New London; retaken on 10 October 1779 in latitude 40°26'N, longitude 72°13'W by HMS Solebay (Thomas Symonds commanding), and brought into New York.

Intended voyage: from England to British America.

Court papers numbered CP 1-5:-

  • [CP 1]: note made about the day and place of recapture, 15 October 1779;
  • [CP 2]: affidavit of papers brought in by the prize master William Hobbs, master's mate of HMS Solebay, 27 October 1779;
  • [CP 3]: libel in Symonds v The ship Badger, 27 October 1779;
  • [CP 4]: monition, 27 October 1779;
  • [CP 5]: account of sale of the ship, for £240 18s 6d after costs, 20 November 1779.

[Decision: condemned, if no response to the monition by 16 November 1779.]

Ship's Papers numbered SP 1:-

  • SP 1: manuscript copy of the letter of marque of the Defiance.

[Papers previously wrongly identified as Court papers: 1-3; Ship's papers: 4-5 (large pencil numbers): sorted and renumbered in 2024]. CP 5 added from HCA 49/91.
