Description

British New York Vice-Admiralty Court.

Captured ship: America (commander Anthony Shoemaker).

Capture history: an American privateer (140 tons, 14-16 guns, 40-52 men, formerly the Scottish ship Nancy (master John Hunnter) taken by an American privateer, Gilbert commanding earlier in 1779), now bound from Boston to Fredericksburg, Virginia, in ballast and on a cruise for two weeks, and then to pick up freight for Nantes; taken on 11 October 1779 off Cape Henry by HMS Perseus (George Keith Elphinstone commanding), and HMS Delight (John Inglis commanding), and brought into New York.

Intended voyage: a cruise from the United States.

Court papers numbered CP 1-7:-

  • [CP 1]: affidavit of papers brought in by the prize master John Buchanan, midshipman, 27 October 1779;
  • [CP 2]: libel in Elphinstone v The privateer America, 27 October 1779;
  • [CP 3]: monition, 27 October 1779;
  • [CP 4]: claim and answer by Thomas Buchanan for himself, George Buchanan and John Buchanan as owners of the Nancy, 3 November 1779;
  • [CP 5]: deposition of Anthony Shoemaker, 3 November 1779;
  • [CP 6]: replication.
  • [CP 7]: envelope from HMS Perseus containing the letter of marque [which is not here].

[Decision: condemned, if no response to the monition by 16 November 1779]

Ship's Papers numbered SP 1-3 (Massachusetts papers):-

  • SP 1-SP 2: official ship's papers;
  • SP 3: owners' instructions to Shoemaker, 8 September 1779.
