Description

High Court of Admiralty.

Captured ship: Africain of St Malo (commander Nicolas Jugan).

Capture history: a French merchant ship and troopship with a letter of marque (400 tons, 10 guns, 40 crew, and 185 French officers and soldiers) bound from Brest, laden with 180 tons of provisions, 30 chests of muskets and 60 bales of linen; taken on 12 December 1781 in the Bay of Biscay by HMS Valiant (Samuel Granston Goodall commanding), in sight of Admiral Kempenfelt's squadron [one of 15 naval transports taken in the Second Battle of Ushant], and brought into Plymouth.

Intended voyage: from France to the Caribbean Islands or to the East Indies.

Court papers numbered CP 1-5-

  • [CP 1]: attestation as to papers (numbered 1-3), already sent to the court, made by Goodall, 27 December 1781, and sworn at Portsmouth;
  • [CP 2]: standing interrogatories;
  • [CP 3]: three depositions taken at Portsmouth, of Nicholas Jugan, Julien Peigné and François Murat, commissioners' affidavit as to the taking of the depositions, and commissioners' affidavit as to the sending of the ship's papers, 27 December 1781;
  • [CP 4]: copy of Goodall's attestation as to papers extracted from the Registry;
  • [CP 5]: translations of the ship's papers.

Ship's Papers numbered SP 1-3:-

  • SP 1: muster roll;
  • SP 2: letter of marque;
  • SP 3: ship's pass.

[Papers previously wrongly identified as being from HCA 32/260/3 and numbered as Court papers: 1-13; Ship's papers: 14-16 (large pencil numbers): sorted and renumbered in 2024].
