Description

High Court of Admiralty.

Captured ship: Adriaane or Adriana of Dordrecht (master Jacob Veer).

Capture history: a Dutch merchant ship (28 tons, 10 men), bound from Malaga to Ostend, laden with wine, raisins, figs, lemons, oranges and almonds; taken on 25 December 1780 off Start Point by HMS Pilote (Lieutenant Richard Boger commanding) and HMS Rattlesnake (Peter Clement commanding), and brought into Plymouth.

Intended voyage: from Spain to the Austrian Netherlands.

Court papers numbered CP 1-63 [joint capture and neutral claims]:-

  • [CP 1]: attestation as to papers (numbered 1-53) brought in by the prize master Thomas Facey of HMS Pilote, 22 January 1781;
  • [CP 2]: standing interrogatories;
  • [CP 3]: three depositions taken at Plymouth of Jacob Veer the elder, Jan Damen, and Jacob Veer the younger;
  • [CP 4]: commissioners' affidavit at Plymouth, 24 January 1781;
  • [CP 5-CP 6]: allegations on behalf of HMS Rattlesnake as joint captor, 19 February 1781;
  • [CP 7]: commission to take depositions at Portsmouth, 19 February 1781;
  • [CP 8]: appointment of proctor by Clement, 21 February 1781;
  • [CP 9-CP 10]: release of interest by Thomas Kidger gunner, John Harrison midshipman and Peter Bowman seaman, all of HMS Rattlesnake, 24 February 1781, and their three depositions taken at Portsmouth, 26 February 1781;
  • [CP 11]: commissioners' affidavit at Portsmouth, 26 February 1781;
  • [CP 12]: translations of the ship's papers, 6 April 1781;
  • [CP 13]: accounts of sales of the cargo, expenses etc, at Plymouth Dock (net proceeds £1,023 17s 2d), 6 April - 17 August 1781;
  • [CP 14-CP 15]: attestation and claim by John Kirkpatrick Escott, of Messrs Kirkpatrick Escott and Reed of London, as the agent of François Bowens of Ostend; with a schedule of the goods claimed, 5 February 1781;
  • [CP 16-CP 32]: a set of attestations and claims, with translations, numbered 1-17 (with CP 27 /No 12 and CP 31 / No 16 being bills of lading), from Ghent, Ostend, Bruges, Brussels, and Dordrecht;
  • [CP 33-CP 36]: a further set of attestations and claims, with translations, from Ghent and Ostend;
  • [CP 37-CP 38]: attestations and claims by Anthony Songa of London, as the agent of Jose van Berblock of Ostend and of John Baptiste Liagne of Antwerp;
  • [CP 39-CP 48]: a further set of attestations and claims, with translations, marked A-D, H-Y (no N), AA-BB, from Ghent, Brussels, Antwerp, Courtrai;
  • [CP 49-CP 52 ]: three copies of a schedule of goods claimed by Anthony Songa, with the sentence of the court for restoration of most of the goods claimed and a further copy of the same schedule, 27 April 1781;
  • [CP 53-CP 54]: two commissions for restoration of goods to Songa;
  • [CP 55-CP 59]: restoration of goods in Plymouth, and attestations as to some missing cargo, and account by Songa of the missing cargo; returned 31 May 1781;
  • [CP 60]: extract from the registry of two bills of lading, 1782;
  • [CP 61-CP 63]: affidavit and schedule of goods unclaimed in Plymouth, 1783.

Ship's Papers numbered SP 1-53:-

  • SP 1-SP 48: bills of lading [46 is wanting];
  • SP 49: certificate that Samuel Crena of Dordrecht is the owner of the ship;
  • SP 50: certificate from the Dutch consul at Malaga;
  • SP 51: muster roll;
  • SP 52: Dordrecht pass;
  • SP 53: French pass.
