Description

British New York Vice-Admiralty Court.

Captured ship: Admiral Zoutman (master William McFaden).

Capture history: an American merchant ship with letters of marque (200 tons, 25 men, formerly the British ship Major Pearson, whose crew mutinied and took her into Egg Harbor [in 1781]), now bound from Philadelphia, Pennsylvania to Havana, Cuba, laden with provisions and dry goods; taken on 12 March 1782 off the Capes of Delaware by HMS Garland (Charles Chamberlayne commanding), and brought into New York.

Intended voyage: from the United States to the Caribbean Islands.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by the prize master John Smith, midshipman, 16 March 1782;
  • [CP 2]: libel in Advocate General at the relation of Chamberlayne v The ship Admiral Zoutman and cargo, 16 March 1782;
  • [CP 3]: monition, 16 March 1782;
  • [CP 4]: answer and claim of George Grundy merchant of New York on behalf of Thomas Lempriere merchant of London, 27 March 1782;
  • [CP 5-CP 9]: five depositions of Septimus Davis, John Cochran, William McFaden (twice), David Ferguson, 21 March-13 May 1782;
  • [CP 10]: affidavit that Grundy had been expecting letters from Lempriere on the Major Pearson, 29 May 1782;
  • [CP 11]: replication;
  • [CP 12]: rejoinder.

Ship's Papers numbered SP 1-5 (Pennsylvania papers):-

  • SP 1-SP 3: official ship's papers, and privateer commission;
  • SP 4-SP 5: ship's business papers, with SP 4 (an armament list) produced in court.
