Folios 259-260: Francis Newcombe, HMS Foudroyant, off Alexandria (previously Commander of HMS Albanaise). Advising that, contrary to the normal custom of granting Officers, who were Prisoners of War, their Parole of Honour and making them a liberal allowance to subsist on, he and his fellow Officers were in a close Prison, similar to the kind for Common Felons in England, and kept with the same restrictions as the Seamen. He and his officers were confined for 5 months until an Exchange of Prisoners took place when he was sent to Gibraltar. He also mentions the order from the Governor of Malaga and the memorial from Mr [Thomas] Gregory, the British Commissary for Prisoners residing at Madrid addressed to the Prime Minister and his answer (enclosed).
Folios 261-262: enclosure with folios 259-260. Memorial from the Commissary General for the British Prisoners of War at Madrid to the Prime Minister of Spain, requesting a Parole of Honour for Captain [Francis] Newcombe and Officers of the late HMS Albanaise and replies. Thomas Gregory appealing to His Excellency Peter Cevallos [Pedro de Cevallos Guerra?] for the Parole for this officer and the other officers of HMS L'Albanaise, currently being held at the Castle of [Gibraltaro?] [Castle of Gibralfaro?]. Their vessel entered the Port of Malaga following the crew's mutiny. He cited a previous case regarding the officers of HMS Diana which was carried into Brest the previous year where they were immediately sent home to England by the French Government. Also includes Peter Cevallos's [Pedro de Cevallos Guerra's] answer advising that he had asked the King who has not granted the request. In addition includes a reply from Aranjuez dated 7 February 1801 by [Fruxillo?] the Governor of Malaga stating that the Officers of the Guard are only allowed to permit a Prisoner at a time, Officers included, to be absent for an hour in the morning and in the afternoon accompanied by a Guard to purchase food.
