Description

Folios 266-267: Samuel Jackson, HMS Mosquiito [Musquito], Hawke Roads, Humber. Asks for the enclosed letter to be presented to their Lordships. After having stated the case of these men he received directions to discharge those who were protected by Act of Parliament and concluded that this meant the boat steerers and line coilers only and detained the others as he was still of the opinion that it had long been customary to impress such men and that they were not exempt from the press after the ship had made her voyage and was in a place of safety. Asks to be informed how far he may be justified in detaining them as he does not think that having stated their case he can be authorised to discharge them of his own accord.

Folios 268-269: enclosure with folios 266-267. Letter dated 10 September 1805 from John Marshall, Whitby, to Captain Jackson, on board HMS Mosquito [Musquito]. His reply of 20 August [1805] to his partner Mr Preston's letter concerning the discharge of William Parker, John Holdforth, William Webster, Daniel Ibbetson and Joseph Britain, 5 Seamen belonging to the Lively is unsatisfactory. he has an order from the Admiralty for their absolute discharge and yet they are retained because of his opinion that they were not protected. The Seamen were as much protected as any Officers and he now formally demands their discharge, otherwise he will be obliged to take an action against him which he would be extremely sorry to do.
