Folios 377-378: Joshua Sydney Horton, Regulating Officer, Liverpool. Sends the enclosed certificates [not present] produced by William Pengelly, said to be the certificates of his discharge from HMS Victory and HMS Gladiator, but from the report of Mr Dalloway, Surgeon on HMS Princess, and from Captain Horton's own observation, he is evidently an imposter. He is a very serviceable man but claims to have been invalided with a contraction of the leg muscles, which is not apparent to any degree. Mr Dalloway has passed him as fit for service. The certificates do not specify any complaint for being invalided. The man has been detained aboard HMS Princess pending further instructions. Reports that he has complied with the order of 8 March with respect to William Cumberland. He was examined before a Magistrate yesterday, who found insufficient evidence to institute any proceedings against him. The informant Wilcox sailed from Liverpool to America in the same vessel as Cumberland, and although there was no evidence to proceed, the Magistrate approved Captain Horton's action.
