Folios 364-365: Joshua Sydney Horton, Regulating Officer, Liverpool. He has investigated Lieutenant Baly's conduct, as outlined in the enclosed letter. It appears that the letter was written by James Clemenson, who was discharged from Lieutenant Baly's gang, as ordered by Captain Horton, on 22 September, for being absent from duty. A charge of bribery was made against him by Captain Thomas, which was credible and has now been proved. The accusations against Lieutenant Baly are nonsense and malicious. Captain Horton is perfectly satisfied with his general conduct.
Folios 366-367: enclosure with folios 364-365. Anonymous letter dated 27 February 1809, Liverpool. Accusations that Lieutenant Baly is cruel to the men under his command, discharges them without the Captain's knowledge, and rarely accompanies them on their duty, exposing them to risk to their lives.
