Folios 85-86: Joshua Sydney Horton, Regulating Officer, Liverpool. Sends enclosures relating to Samuel Stubbs, who was ordered to be discharged on repayment of expenses on condition that he was truly an apprentice. Captain Horton believes he was. He sent the order to Captain Colquitt with the ususal instruction to comply having noted the expenses at the Rendezvous. The order was returned on the afternoon of 10 January, with the observation that Samuel Stubbs had been drafted to the Betsy Caines tender. The next morning the Captain of the tender called upon Captain Horton at Lieutenant Evans's Rendezvous, Coopers Row, when he was given the order to return Stubbs to HMS Princess, immediately sending Lieutenant Clarributt the Admiralty letter at the same time. The Betsy Caines was ready to sail at the next tide. Yesterday afternoon he received the enclosures from Lieutenant Clarributt with the list of S Stubbs, which had been sent back again with hin from HMS Princess with Captain Colquitt's reasons for not receiving him as per the list. This illustrates the difficulty of the two services under distinct commands. Wishes to know how Captain Colquitt can reject the boy, or any other person sent by Captain Horton from the tender or the Rendezvous. Furthermore, had Lieutenant Clarributt complied with the spirit of the order and sent him back to HMS Princess he would not have received him back on the tender without an order from Captain Horton. The Lieutenant's conduct has not met with his approval. Captain Horton's's only alternative was to order the boy to be sent from the tender to the Rendezvous. Further complaints about the clashes between the service on shore under his command and that of the receiving ship. Wants the Captain of the receiving ship to be under his command. Believes that Lieutenant Clarributt wishes a transfer. Recommends Lieutenant Samuel Baly, who has been employed in the Impress service at Liverpool for nearly 3 years, and would be a proper Officer to command the Betsy Gaines tender.
Folio 87: enclosure with folios 85-86. Certificate dated 11 January 1809 for the discharge of Samuel Stubbs from the tender Betsy Caines into HMS Princess. Note from Captain Colquitt, 12 January 1809, that he cannot accept a person directed to be discharged.
Folios 88-89: enclosure with folios 85-86.Letter dated by 7 January 1809 by the Admiralty Office to Captain Colquitt, HMS Princess. Have received Captain Colquitt's report of 5 January regarding two men aboard HMS Princess: Samuel Stubbs and Richard Banks. Instructions to discharge the former on repayment of expenses, providing he is a bone fide apprentice, and to discharge the other on receiving two able-bodied Landsmen in exchange.
Folio 89A-89B: enclosure with folios 88-89.Letter dated 13 January 1809 by Edward Clarributt, HMS Betsy Caines, to Captain Horton, Liverpool. Samuel Stubbs was discharged into HMS Princess as ordered , but he has been returned with Captain Colquitt's reasons on the receipt. As the tender is due to sail, requests instructions.
