Folios 216-217: Edward James Foote, HMS Sea-horse [Seahorse], Spithead. Reports that only about 20 of the 117 ships in the convoy were obeying his instructions, but since much of the disobedience was at night he could not identify the ships concerned. Because the Admiralty's letter of 28 October informed him that the Law Officers did not think the complaint he made in September 1795 against Thomas Smith, Master of the Ceres, was strong enough to be successfully prosecuted, he does not know what to do, as in that instance Mr Smith clearly disobeyed his signals and then swore at him on his own Quarterdeck on HMS Niger, as that ships's commissioned and warrant officers could testify.
