Folios 193-194: Edward James Foote, HMS Sea-horse [Seahorse], Spithead. Encloses an extract of his letter of 7 August 1795, an extract from the Admiralty letter of 9 August and a full copy of their letter of 29 August of that year. Reports that Thomas Smith is still in command of the Ceres and believes he will continue to disobey Captain Foote's signals
Folio 195: enclosed with folios 193-194. Copy of a letter dated 29 August 1795 from Evan Nepean, the Admiralty, to Captain Edward Foote, HMS Niger, Spithead. As the Admiralty Proctor, Mr Gostling, has been directed to prosecute Thomas Smith, Master of the Ceres, for disobeying signals when under convoy, asks for a copy of Captain Foote's log for the relevant period and any other information he has regarding this disobedience. NB Captain Foote reports he has fulfilled the directions in this letter.
Folio 196: enclosed with folios 193-194. Extract of a letter from the Admiralty to Captain Edward Foote, 10 August 1795. Their Lordships have passed Captain Foote's observation on the conduct of Masters of merchant vessel to the underwriters, and sent his complaint against Thomas Smith, Master of the Ceres, to the Admiralty Solicitor for action.
Folio 197: enclosed with folios 193-194. Copy of a letter dated 7 August 1795 from Captain Edward James Foote, HMS Niger, off Portland, to the Admiralty. Reports that most of the vessels under his protection ignore his signals unless a shot is fired to enforce them, and wishes action to be taken against Thomas Smith, Master of the Ceres of Lynn, George Hogg, Owner, under the act mentioned in the convoy instructions. The Lieutenants and Master of the Niger can testify to Mr Smith contradicting the Captain on his own Quarterdeck.
