Description

Folios 89-90: George Dawson, 121 Great Russel Street, Bloomsbury. He is sending a number of documents for review regarding the unfortunate situation he has been in for the last 7 years.

Folios 91-92: enclosure with folios 89-90 dated 11 January 1796 from George Dawson, 121 Great Russel Street, Bloomsbury He is enclosing documents including Lord Howe's letter and a copy of Counsel's opinion the original of which was sent a year ago. He has suffered hardship following his Counrt Martial and asks for teh matter to be reviewed.

Folios 93-94: enclosure with folios 89-90 dated 8 November 1794. Copy letter from Lord Howe, HMS Charlotte, Torbay to George Dawson. He has received his letter of 19 October 1794 which has been waiting for his return to the anchorage. Mr Erskine who has investigated his case, has advised how to proceed to obtain relief. He (Lord Howe) is not able to offer any further advice. It has been noted that it was he (Lord Howe) who promoted him (George Dawson) on account of his repeated gallant actions in America without having any prior knowledge of him or his connections.

Folios 97-98: enclosure with folios 89-90 dated 29 December 1795 memorial from George Dawson, former Captain of HMS Phaeton, 121 Great Russel Street, Bloomsbury. He entered naval service in 1755 onboard HMS Saint George, under the flag of Admiral Lord Hawke. In November 1788 he was dismissed from the Navy following a Court Martial where 14 charges were considered, 11 dismissed and 3 upheld. He believes the charges were brought through malice and vengeance. He has obtained Counsel's opinion on the harges and asks for the case to be reviewed. He testimonies from respected people in teh Navy. He served for 17 years in North America before and during the war, and served for 34 years in all without any previous charge being laid against him. He suggests refering to Admiral Cosby under whose command he was last serving, regarding his conduct.

Folios 99-100: enclosure with folios 89-90 dated 2 October 1794 from T.Erskine, Sergeant's Inn. Copy of Counsel's Opinion regarding the case of Captain George Dawson. He has read the minutes of the Court Martial with regret and disgust. He knows that the Court comprised honourable men, but not being experienced in judicial matters, they could misapprehend the evidence. He believes the fact that there were 14 charges brought, although 11 were dismissed, influenced the decision on the other 3 charges which were proved. Captain Dawson's conduct to Lieutenant Lucas was in his defence and meritorious. The charge regarding injury and injustice to individuals was to brought by a third party, another which was so ridiculous as to be not worthy of comment, while the third, regarding the Midshipmen's pay, might merit some criticism but not being dissmissed for all time from the service. He asks for the evidence to be reviewed.
