Folios 633-634: John Davies, HMS Otter, Downs. Reports that he received the papers advising him to discharge eleven men if the contents enclosed with the order were found to be true. Encloses affidavits from the Officers employed on the Service and outlines his actions in regard to the Protection documents they provided him with. Reports sending his Second Lieutenant on board the Privateer to establish if they had clearance from the last port and was advised that they did not. He then detained the eleven men. Encloses a letter from J Graham stating he may sue [folios 639-640] and asks for their support of his actions or a order to discharge the men.
Folios 635-636: enclosure with folios 633-634. Affidavit by John Richardson, Second Lieutenant, HMS Otter, 14 August 1805. States that on 15 June 1805 he was sent by Captain John Davies to the Cruizer Privateer in Hoseley Bay to ascertain whether they had clearance from the last port for the eleven men in question. The Captain of the Privateer responded he had not.
Folios 637-638: enclosure with folios 633-634. Affidavit by William Barnham Riders, First Lieutenant, HMS Otter, 14 August 1805. States that he was sent by Captain John Davies on board the Cruizer Privateer in Hoseley Bay to muster men. He was ordered to detain eleven men due to the discrepancies in the Protection Certificates held on board. Outlines his actions before they were detained.
Folios 639-640: enclosure with folios 633-634. J Graham, London to James Crow, 1 August 1805. Advises that he is aware that Captain John Davies has been ordered to discharge him and his fellow detainees but states that he believes Captain John Davies has some objections and is requesting a fresh Protection for the ship. If he continues to hesitate in discharging them asks that they let him know and he will take steps that Captain John Davies will have to pay both pay and prize money to them all. Also asks for the christian and surname of the officer who impressed him so that he can ask that officer to give evidence. Advises him that it is probable that he will be discharged to a port in Scotland and that he is to take this letter to a bank who will furnish him with twenty pounds and that he is to be sure that he is given a proper discharge or he could be impressed again.
Folios 641-642: enclosure with folios 633-634. John Davies, HMS Otter, Downs to the Admiralty, 16 August 1805. Following orders, he has discharged George Dalton.
Folios 643-644: enclosure with folios 633-634. Richard Totter, Hull to the Admiralty, 29 July 1805. Request for the discharge of George Dalton, Cooper of his ship, who was impressed from her on her passage from the Davis's Straights to Hull by HMS Otter.
