Description

Folios 179-180: Samuel Chambers, Port Mahon, Spithead. Emanuel Elkin, Midshipman, who is disrated for improper conduct is threatening him with prosecution so he wishes to put his side of the case. On January 5th 1805, his vessel was alongside at Port Royal when Lieutenant John Marshall complained that Elkin was insolent. He was disrated but later tried to trip up Marshall who put him in irons. Elkin threatened Chambers with a civil action so he got 24 lashes as he was too young for a Court Martial. He was discharged into HMS Centuar by Admiral Gails. A year later he received an intention of prosecution letter as did Marshall who is now on Impress service at Pool. On September 28th Elkin came aboard HMS Port Mahon where the 1st Lieutenant tried to impress him but he produced a certificate frpm HMS Gladiator but the Surgeon said he was in perfect health so it was presumed a forgery. Later Chambers found that Captain Boyle dismissed him for insolence and not for ill health. Admiral Otway directed Chambers to send him to the Royal William as no Captain would take him.

Folio 181: enclosure with folios 179-180. From John Marshall. Describes several incidents of insolence from Emanuel Elkin at Port Royal of refusing to move, to obey orders, singing, accusing the Captain of drunkeness, tripping him up. Inspite of being put in the hold, or sent ashore, he continued and was eventually put in irons and then flogged on the bottom in front of the crew.
