Folios 324: Samuel Colquitt, HMS Princess, Liverpool. He received a letter from Knight & Jones concerning James Daley, who was recently on board the ship, which Mr Bicknell had sent to them to request him to state the case, and to enclose the writ of habeas corpus which was serve on him. James Daley was impressed at Liverpool on 20 December [1805] by HMS Ganges under the direction of Captain Cumberland and was on 26 December [1805], before the serving of the writ, discharged into the Rose tender for the disposal of the Commander in Chief at Plymouth. He informed Mr Morrow, the attorney at this port and expect some communication from him regarding the disposal of the writ. He hopes this excuses the delay. Mr Bicknell should know all the circumstances under which the man was impressed which he has stated to Captain Cumberland.
Folios 325: enclosure with folio 324. Affidavit dated 31 December 1805 by Biddy Rogers , witnessed by R Yates, sworn before J Meller, Justice of the Peace for Tower Hamlets. Biddy Rogers of 42 Parsons Street, in the parish of St Johns, Wapping, Middlesex, wife of Leary Rogers, Shopkeeper, swears that James Daly was impressed on Saturday 21 December by an Officer for the port of Liverpool and is now on board HMS Princess. He was employed for the last 4 years by Mr Richards, Contractor for the stone work at the London and West India Company docks at Blackwall and for most of that time lodged with her. Gives him a good character and says he has a wife and 2 children and an elderly mother all dependent on him. She has known him since his infancy and he was never employed as a waterman and was never at sea except as a passenger from Ireland to England. he was at Liverpool in order to go as a passenger to Ireland to see his elderly mother and intended to return to his wife and family in London. She has seen a letter dated 25 January written by James Daly which states he has not entered as a volunteer and asks for efforts to be made to obtain his discharge.
Folio 326: enclosure with folio 324. Petition dated 31 December 1805 from Messrs Richards & Co, Contractors for the stone works of the London and West India docks. petition that James Daly has been employed by them for many years and was impressed at Liverpool and is now on board HMS Princess in the circumstances described in the affidavit.
