Folios 236-237: Joseph Bingham, HMS Magnanime, Sheerness. During the sitting of the Court Martial of Captain Probyn of HMS Blossom, chaired by Captain Bingham, upon charges brought by Lieutenant Unarell of cruelty and oppression, it appeared to the Court that under the 33rd Article of War, the word aggressive was coupled with scandalous, infamous, cruel and fraudulent. This would result in an Officer being charged with aggressive behaviour receiving the same punishment as the more serious crimes without any mitigation, which may not merit such severe punishment. It is the desire of the Court that he makes representations to the Admiralty in respect of Officers found guilty of behaving in an aggressive manner only, which would relieve the consciences of those delivering a guilty verdict.
