This series contains files of the Ministry of National Insurance and successors relating to cases submitted to the minister responsible for determining the insurance classification, identity of employer and insurability of persons under the National Insurance Act 1946 and related legislation.
The files contain the occupation of the claimant, original claim, departmental papers and the decision of the minister or his representative.
The series also contains two volumes of all High Court and Court of Session judgements, 1950 to 1970, on questions of insurability.
Some earlier files refer to the period immediately before 5 July 1948, when the two Acts came into effect.
Corresponding files in the LX series were created when cases needed separate action in the Solicitor's Office. These are in PIN 31
Section 43 of the National Insurance Act provided for the determination of all questions relating to classification and insurability by the minister responsible or his appointed representative. Section 36 of the National Insurance (Industrial Injuries) Act similarly provided for the minister or his representative to determine whether a claimant was employed in insurable employment during the period in question or who was liable for payment of contributions as the employer of the insured person.
The National Insurance Act divided all insured persons into three classes:Class I - Employed persons, under contract of employment, entitled to all benefits.Class II - Self-employed persons, entitled to all benefits except those for unemployment and industrial injuries.Class III - Non-employed persons, entitled to all benefits except those for sickness, unemployment and industrial injuries, and maternity allowances.
Prior to 5 July 1948 decisions were made under the National Health Insurance Acts 1936-1941 and the Unemployment Insurance Acts 1935-1944.
