Provision for giving such decisions was made by Section 161 of the National Health Insurance Act 1936, which re-enacted the provisions formerly made by Section 66 of the National Insurance Act 1911, Section 27(2) of the National Insurance Act 1913, Section 10(1) of the National Health Insurance Act 1920 and Section 89 of the National Health Insurance Act 1924. The powers of the National Health Insurance Commission were transferred to the Minister of Health on 1 July 1919, in pursuance of the Ministry of Health Act 1919.
Questions determined by the minister were as follows:(a) whether any employment or any class of employment is or will be employment within the meaning of those Acts, or whether a person is or was a person employed within the meaning of those Acts, or whether a person is or was entitled to become a voluntary contributor;(b) as to the rate of contributions payable by or in respect of any insured person;(c) as to the rates of contributions payable in respect of an employed contributor by the employer and the contributor respectively;(d) as to the person who is or was the employer of an employed contributor.
Any person aggrieved by the decision of the minister on any question under (a) or (d) had the right of appeal to the High Court. In addition, the minister, instead of himself deciding whether any class of employment was or would be employment within the meaning of the Act, could submit the question for decision to the High Court. The decision of the High Court was final.
