Plaintiffs: Cropley [Ashley-Cooper] Earl of Shaftesbury and Lord Robert Spencer (since deceased).

Defendants: George [Spencer-Churchill] Duke of Marlborough and Susan [Spencer-Churchill] Duchess of Marlborough his wife, Francis Almeric [Spencer] Lord Churchill, Francis George Spencer, George Augustus Spencer, Augustus Almeric Spencer, William Henry Spencer, Henry George Spencer, John Welbore Sunderland Spencer and Robert Charles Henry Spencer, infants by said Francis Almeric [Spencer] Lord Churchill their father and guardian, George [Spencer Churchill] Marquis of Blandford, Lord Charles Spencer Churchill, Lord Henry Spencer Churchill (since deceased) Lord John Spencer-Churchill and Lady Caroline Spencer-Churchill, afterwards the wife of David Pennant junior, esq (since deceased) by their guardian and James Blackstone, esq (since deceased).
