Folios 261-262. Letter from W and E Willoby [William Willoby and Edward Willoby], Clerks to the Guardians of the Berwick-upon-Tweed Poor Law Union, to the Poor Law Commission. It encloses resolutions passed by the board at its meeting on 19 March 1839 concerning the law of bastardy. Enclosed is a printed document. It names the Chairman, John Hogarth, and lists seven resolutions concerning the law of bastardy. 1. The present law for affiliating and obtaining orders for the maintenance of bastard children are because of the expense attendant on them, ill adapted in reimbursing parishes, for the support of such children. 2. There is need for legislation which enables parishes to obtain and enforce such orders more simply and cheaply. 3. This will be best attained as follows. The justices in Petty Sessions, upon evidence of the mother, corroborated by such testimony as is now required by 4& 5 William IV c 76, shall, subject to appeal to Quarter Sessions, have power to make such order for reimbursing parishes, as shall appear to them just and reasonable. Arrears to be recoverable as directed by the said Act; except that instead of the putative father being brought before the justices by warrant, it shall be sufficient that he be summoned to appear; and with this addition that in default of goods on which to levy, or wages to be attached, he shall be committed to the common gaol or house of correction for such period as the legislature may direct. 4. In cases where the putative father does not reside within the jurisdiction of the justices making the order, two justices of the place where he resides, shall have jurisdiction for enforcing the order, in the same manner as cases for orders for maintenance of relations. 5. Sums received from the fathers should be received by the overseers of the parish, chargeable with maintaining the children and that the expense of obtaining such orders shall first be defrayed by the overseers and reimbursed to them by the father, at the discretion of the justices. 6. Petitions founded on these resolutions be presented to both Houses of Parliament; Earl Grey be requested to present the petition in the Lords and the Members for North Northumberland in the Commons. 7. These resolutions be printed and copies sent to the Home Secretary, the Poor Law Commissioners, the assistant commissioner for this district and to the Boards of Guardians for Northumberland, Durham and Cumberland and that they be advertised once in the two Berwick papers.
