Folios 160-162. Letter from A Y Bird, Churchwarden, William Grosvenor and James Southern, Overseers, for the Borough of Kidderminster, to the Poor Law Commission, dated [by mistake] 17 February 1837 but received by the Commission on 16 February 1837. The letter acknowledges receipt of the instructions to call a meeting of ratepayers to obtain their consent to the sale of the workhouse to the guardians of the Kidderminster Poor Law Union. Enclosed is a report of the meeting, which took place 11 February 1837, with the comment added, 'the result being different from what we either wished or expected'. As the sale cannot take place at present, the certificate is not enclosed for signature and they await further instructions from the Commission. The report on the meeting of 11 February 1837 in the vestry of the parish church is a copy from the record in the 'Vestry Book' [the same account as that forwarded by Thomas Hallen, solicitor, with his letter to the Commission of 14 February 1837, although without the signatures]. The report confirms the proposal to sell the workhouse and the resulting amendment, which adds conditions to the ratepayers' and owners' consent for sale. These conditions are that part of the proceeds from the sale be used to fund, firstly, the parish application for a Local Act of Parliament to enable the assessment of landlords of small tenements for poor rates, secondly, to pay off the debts owed by the parish authority of the Borough of Kidderminster. The amendment had been approved, also a proposal to set up a committee to negotiate the conditions of the sale with the guardians. Annotations: a referral to Robert Weale, Assistant Poor Law Commissioner for the district, for his opinion and his proposed response, dated 17 February 1837 (see below), which was approved. Weale advised the Commission to remind the parish officers that the Commission had already advised them, through the Kidderminster Poor Law Union, not to apply for a Local Act for the purposes of assessing the landlords of small tenements as there was a possibility that the Commission might enable a general measure to that effect. As the parish officers had gone against this advice, the Commission cannot sanction the funding of the costs out of the sale of the workhouse, against the wishes of the guardians.
