Folios 333-339. [Continued from MH 12/5969/] Deposition of Jane Stanley. She is the wife of William Stanley and they are subtenants of Thomas Davies. They have a child, William Stanley, and a 'nurse child', Emma Wilkie. Davies had a child, Thomas, which died when about nine months old. Her son, William, was vaccinated by Dr Johnson, at his premises in Russell Street, when about nine months old and Emma was vaccinated by Dr Wilson at her house just before Christmas. Before her child was vaccinated someone called twice at the house asking for children to vaccinate, but she preferred to have it done by her own doctor. This person did not vaccinate William, Emma or Thomas Davies. The only person named Thomas Davies in the house at this time was the father of the child. Statement by C [Lord Courtney, Secretary to the Poor Law Board], 17 July 1852 to Henry Fleming, Assistant Secretary to the Poor Law Board. He agrees with Farnall as to the treatment of Emett, Gill and Steele, but feels that Donlevy has not shown sufficient remorse and that they should all be dealt with in the same way, whether dismissal or to call for their resignation. All the four vaccinators employed deputies who charged for vaccinations they had not performed, the person who checked the vaccinators' returns signed his enquiry and the vaccinators signed a declaration that they had personally performed the vaccinations, although this was subsequently not found to be so. Three of the vaccinators state that the vaccinations were performed by themselves or their named deputies. Donlevy concealed the fact that he employed a deputy and signed his name as if he had performed all the vaccinations. There is mis-statement in each case, but greater mis-statement by Donlevy, although not enough to justify them to resign [illegible]. Annotated: He feels that the degree of carelessness and dishonesty in discharging their public duty proven against all the medical officers means that he should request their immediate resignation. However Farrell's recommendations after his local enquiry [illegible]. He feels that there is a difference between Donlevy's case and those of the other medical officers, although they have all been guilty of 'equal laxity and dishonesty' and if the Poor Law Board do not require their resignation, they should deal differently with Donlevy. If they are not to be asked to resign he therefore recommends a severe censure. Letter from John Trollope to Courtney. He notes Courtney's opinion on the course of action in the Liverpool case and would not impose his opinion on that of Courtney and Fleming if they think a reprimand sufficient, as he does not have all the papers relating to the case. Mr Cochrane, who is dealing with the St Martin's case is referred as is 'the quality of the bread'. 20 July 1852. Gill, Steel, Emett and Donlevy are doctors who have been employed by the Liverpool Select Vestry as vaccinators under the Vaccination Act. Vaccination is not relief to the poor and they are not therefore subject to the powers of the Poor Law Board. The only step which can be taken is to terminate their contracts. The above vaccinators are all medical officers employed to attend the poor of Liverpool and only in that capacity are subject to the Poor Law Board. There is no charge against them as medical officers, although their conduct as vaccinators reflects upon their characters, a post for which the Poor Law Board may now consider them unfit. Gill's contract dated June 1842. Steel's contract dated May 1849. Emett's contract dated April 1847. Donlevy's contract dated March 1841. Farnall, 19 July 1852. He feels that the medical officers should be asked to resign as a result of the considerable fraud carried out on the ratepayers of Liverpool and the consequent suffering by the poor due to their neglect of duty. The Liverpool Select Vestry and the Board of Directors took reasonable precautions. The request for their resignation is the most lenient course open to him.
