Folio 275. Letter from Henry Saunders, Clerk to the Guardians of the Kidderminster Poor Law Union, referring to the nomination paper marked 'A', forwarded on 29 March 1848 requesting an opinion on its validity. The response then that Mr Allen [John Allen] was not disenfranchised by the absence of the Register of Owners, providing he sent in a statement as owner, has now become complicated for the following reasons: 1. Mr Allen omitted to send in the required statement, so Mr Saunders declared the nomination void. 2. His decision has caused annoyance and the person nominated continues to attend Board meetings notwithstanding the irregularity. Mr Saunders needs to know, before the next Board meeting, if he made the right decision. He further adds that Mr Allen is a ratepayer in Upper Arley [Staffordshire]. He, therefore, would have been qualified to nominate in that capacity if he had chosen to do so. Annotation: if he did not send in the required statement then he is not qualified to vote as owner and the nomination is invalid. Being qualified to vote as a ratepayer is immaterial, as he did not choose to nominate in that capacity. Answer accordingly. Paper Number: 9138/1848. See also Paper Number: 10467/1848.
