Description

3 individual petitions (prisoner, John O'Donnell, the prisoner's father and Lord Sandon) and 1 collective petition with 2 testimonies (John O'Donnell and Ellen O'Donnell, the prisoner's parents) on behalf of John O'Donnell a former private in the 57th Regiment of Light Infantry convicted at a court martial in Corfu on 22 November 1833 for entering the house of Lieutenant Scriven on 13 November with intent to steal. There are also accompanying letters from Lord Sandon and William Ewart MP and letters of appreciation for their support from the prisoner to Lord Sandon and William Ewart. There is a report stating that the commanding officer of 57th Regiment felt 'that John O'Donnell's character was bad' and 'it is not advisable to mitigate that sentence'. There is a statement of conduct while in confinement including inventory of box. Judge Advocate General, General Commanding in Chief confirms no mitigation of sentence. Grounds for clemency: unpremeditated, drunk at time, nothing stolen from house, only fell asleep in house because drunk, already spent 13 months in solitary confinement on Corfu and several months on board prison ship Fortitude, where conduct been good, previous exemplary service as soldier for nearly 8 years, repentant. Initial sentence: 7 years transportation. Annotated: nil. AV 49
