Folio 209. Letter from Mr George Walkden, Solicitor and Vice Chairman of Mansfield Union to the Poor Law Board. Requesting for an opinion on an application made by the churchwardens and overseers desiring for the revaluation of property for the purpose of poor rate assessment. Whether the Board would direct the guardians to appoint a valuer to be supervised by the guardians, churchwardens and overseers alike or they would appoint one. It is desired that repeated expense of such valuation be avoided as the present valuation of above two thirds of the properties in this parish for the purpose of 'property tax collection' is at 'rack rent.' The valuer may adopt this 'valuation' and be directed to revalue the remaining one third on the stated basis at its present 'rack rent.' Enquiring if adopting such mode is legal? Apprehending that the difficulties experienced in the case of 'Aeg v Churchwardens and Overseers of Bangor' may be avoided in these proceedings. Appealing for a reply available for him to be submitted in a parish meeting due. Annotated: has there been an order for a previous valuation? Acknowledge; send the usual forms referring to the provisions of the article 6& 7 Will IV c 96 s 3 stating that the appointment of a valuer must be made under an order of the Board that then there will be no objection to the valuer making use of an existing assessment, but that he will be responsible for the accuracy of the whole valuation. If a partial valuation is required the guardians may direct it to be made without the order of the board on a proper application being made to them under Article 11& 12 Vict c 110 s 7.
