Folio 304. Draft letter from the Poor Law Commission, to James L Barker, Clerk to the Guardians of the Tynemouth Poor Law Union, acknowledging their letter of 3 January 1839 asking for their opinion on the legality of the claim by the vicar of Tynemouth for the payment of burial fees on the interment of paupers. It states that the views of the Commission are to be found in their second report, page 536 and the accompanying circular letter [not included]. The Commission have not thought it right to express a positive opinion on the right of an incumbent to receive a fee for the interment of a pauper, who died in his parish. They are abstaining from enforcing or preventing the payment of a fee, until the question has been determined by a competent legal tribunal. These observations apply to questions one, two, three and five. The forth question, where a pauper is brought to another parish for internment, the vicar cannot as a right be called upon to inter the pauper and can insist upon a fee. Paper number: 118/B/1839.
