Folios 297-303. Letter from James L Barker, Clerk to the Guardians of the Tynemouth Poor Law Union, to the Poor Law Commission, asking for their opinion as to the legality of the burial charges for paupers made by the Reverend Christopher Reed, Vicar of Tynemouth parish. A full set of facts of the case is included. There is a dispute between the vicar and the overseers of the township of Tynemouth, as the overseers have refused to pay the vicar burial fees because they consider the charges unfair and improper. They have followed the opinion of Joseph Phillimore, dated 13 February 1835, stating that the officiating minister is not entitled as a matter of right to demand a fee for the interment of a pauper, but that contrary opinions have been given. They ask if the guardians are liable to pay the burial fees for all paupers who die in Tynemouth Workhouse and whose settlements are within the union but not within the parish of Tynemouth. They ask if the vicar can compel payment for burial of paupers who die in Tynemouth Workhouse or parish and whose settlements are not within Tynemouth Union and their expenses are repaid to Tynemouth Union by the township to which they belong. They ask if the vicar of Tynemouth is entitled to burial fees for paupers who have no settlement that can be ascertained. They ask if on the death of a pauper, not in the workhouse but chargeable to a township in the union though not within Tynemouth parish, if the vicar is entitled to his burial fee if the body is brought to Tynemouth church. They ask if the vicar is entitled to fees for burying people who died in Tynemouth parish but whose settlement is unknown and who received no relief from any township. Annotated: there are many comments including the statement that the commissioners do not think it right to express a positive opinion on the subject and that legal opinion is needed before they will express an opinion.
