Philip Stephens. David Hawkins, late Master, has sent a remonstrance against Captain Clements, late Commander of the Pallas, with an account of misapplication in the receipt and issue of stores. A Court Martial cannot legally be held because of the time which has elapsed between the offense and the issuing of an order for holding the Court. Have conducted an enquiry of Daniel Scarville, Carpenter, Mr. Robertson, Lieutenant of Marines but Clerk to Captain Clements at the time and 1st Lieutenant Mr. Shewen, 2nd Lieutenant Sharp, Mr. Child, the Purser and Mr. Henderson, Boatswain and give their evidence upon oath for 12 separate articles. Conclude Mr. Hawkins' charge is false and malicious
