Folios 206-207. Draft letter from The Local Government Board to James Saunders, Clerk to the East Dereham Local Board in the Mitford and Launditch Poor Law Union referring to his letter 17 April 1885 together with the draft of the provisional order which the board purpose to issue for enabling the east Dereham Local Board to carry out a gas undertaking. Also enclosed was a statutory declaration made by the chairman of the East Dereham Gas Light and Coke Company Limited. They point out that Section 162 of the Public Health Act 1875, 38 & 39 Vic c 55 requires the consent of the gas company to be given by a special resolution of the members, passed in the manner required by the Companies Act 1862, 25 & 26 Vic c 89 and under s 51 of the same act here listed, are other strict regulations which must be adhered to. In the present case the statutory declaration of the chairman of the company does not show that the notice of the meeting of 12 March 1885 specified the intention to propose this formal resolution and also that the notice was given and that a meeting was held in the manner prescribed by the regulations. It does not show that the resolution was confirmed at a subsequent general meeting of which notice was duly given. Furthermore it also does not show that the second meeting was held within the limits of time specified in section 51 of the above act. In this case the board request to be informed by telegram on Monday next whether the provisions of these sections have been complied with in all aspects. If so evidence to that affect must be furnished not later than Tuesday morning by statutory declaration as indicated in the board's letter of 14 April 1885.
