Will of T.B. Burton of Bosley

"To Miss Mary James (daughter of the late Edward James of Bishopswood) who is .........at John Soules of Flaxley 100 gns to be paid to her or her order or to heirs or assigns.....& to be pd out of the money now in the hands of Mr.Willey & Mr. Fielder upon Bond.... also the interest from the said 100 gns from the day of my death to the day of payment. The Bond of mine in the hands of Ann Soule for £100 or gns to be paid out of the aforesaid money (£600) in the hands of Mr. Willey, Mr. Fielder with interest for the same from the day of my death to the day of payment.

To Mrs. Elizabeth Harwood (widow) aged at this time about 86 years & now resides at No.3. Hardford Place, Drury Lane, who by great misfortune is now reduced to keep a school.......I give 20 gns to be pd as soon after my death as possible I will also that the sum of £100 gns shall be left at interest in order for the interest of 5% to make up a sum of £20 by the year for......Elizabeth Harwood during her life & is to be produced in the following manner....... from £18 a year & 10/- paid by Wm.Partridge ironmaster of Goodrich.....for a house & wharf he rents of me at Bishopswood furnace......& out of which there will go £3 a year to make up the rent of Mr.Vaughan's lands & premises which I have upon lease from the said Mr.Vaughan of Monmouth & are now in the possession of Thomas Trounser of the Bollin (Walford)...upon a lease from me during my terms & in case Elizabeth Hardwood should die before the expiration of the said lease...... the interest of the £100 & overplus of rent from Mr.Partridge shall be paid to me executor in trust for the sole use & benefit of Sarah Cross wife to - Cross now living at Birmingham his sister to Mr.John Soule now clerk to Sir Thos.Crawley Boevey of Flaxley.....to be pd during the term of my lease from Mr.Vaughan....by ½ yearly payments.........I give 20 gns for Sarah Cross to be paid.....out of £600 due on bond from Mr.Willey & Mr.Fielder & 10 gns a yr for 3 years after decease..........to Sir T.C.Boevey Bt.all the furniture in my dwelling-house at Boxley which did originally belong to his uncle the Rev. Wm.Crawley which I bought of John Morris, the rest of the furniture not mentioned in the inventory (not however any part of my plate) & not specified as belonging to me - to belong to Mary James or heirs........and my right & title to a lease granted by John Morris to me for 14 years......the use of the furniture during the remainder of my term in that lease of the house & premises on condition she inhabit it herself & makes good all wilful damage to the furniture & makes good to Sir T.C.Boevey.....to my servant Mary Franklin 20 gns & 1 Yr's.wages over what may be due at 24/11/1794 from 15th Aug at 6 gns per year with all my cloths except 2 black frocks to be given to Samuel Franklin & Jas.Franklin & 1 gn each if they come to my funeral with 6 other housekeepers of the parish to carry my remains to the church who shall be entitled to 1 gn each. Five gns.worth of bread shall be given amongst poor (but not belonging to the Workhouse) of Westbury who attend my funeral.....I give my ostrich's egg-shell set in silver & the silver stand with 3 short feet to Rev.John Foley of Newent provided he keeps his promise of having engraved upon the edge of the rim the following words -

"The gift of Capt.Burton of Boxley Gloucs.to his friend John Foley 24/11/1794" If John Foley should have any objection to the legacy or terms I give the same to Hugh Jos.Hansard who(m) I appoint executor & after his decease that son of his who married the daughter of Matthew Burt & was brother to Charles Pyer Burt & to his heirs...........

To my executor 40 gns above all charges he may be at in coming down from London etc.......to John Hansard son of the aforesaid my gold watch & 2 gold seals both antiques one a head of Cleopatra & the other a Cornelian a head of one of the Roman emperors & has a bit of the watch chain hanging to it & has been a ring ........... to Mr.Lloyd Crawley 2nd son to Sir T.C.Boevey the ½ stocked gun with silver furniture & now in the possession of T.C.Boevey I give another whole stock & gun with silver furniture & crest of Crawley family & lately belonging to Rev.Wm.Crawley, Sir Thos' uncle, (which I bought of John Morris) to Sir T.C. Boevey.

My table linen, sheets & napkins made up & not made up to be equally divided between Miss Ann Soule & Sarah Cross. If any of the legatees should murmur or complain of the manner or disposal of the legacies they shall be deprived of all benefit from my will. My coronet cup I give to my agent for my half pay Hugh Jos.Hansard. It is my request he would make use of it as his drinking cup which it has been to me for 50 or 60 years. My East India chintz to Mrs. Hansard. Five gns.of bread & cheese to the poor of Westbury (except workhouse poor) who attend church that day 12 ths after which I was buried. I wish Mr.John Boughton would take the trouble to direct the distribution. I give my executor 30 gns. in trust for sold use of Sarah Hinks wife to George Hinks of the Booth Hall Inn, Gloucester. To Miss Hansard sister to H.T. Hansard 5 gns to Mr.John Wintle jnr.wine merchant at Newnham 5 gns.
