Spiritual will of Ann Fenwick, and one copy, referring to her [civil] will of 12 Sep. 1767 in which she bequeathed legacies of £500 apiece to Thomas Hornyold esq. and George Townely esq., now declaring that these sums were left in trust for the Catholic incumbent of Hornby and Claughton [see also RCHY 2/1/60 below] such incumbent to comply with strict requirements specified in the will, e.g. that he should be a secular priest educated at Douai College and should remember specified anniversaries of Mrs Fenwick's family and friends, that no priest of Robert Hall, nor a 'Gentleman's Priest' nor a pluralist should benefit by the bequest, that mass should be said regularly at either Hornby, Claughton or Caton on all Sundays and holidays, that he should be entirely subservient to his bishop and Grand Vicar, giving detailed instructions in case of national persecution of Catholics, and for the construction of a house and chapel on land at Hornby Town End, for the use of her library, vestments, etc. by the incumbent, for the furnishing of the proposed house and chapel, for the compiling of detailed inventories of goods, for the use of any surplus money towards the celebration of further anniversaries of family and friends and for the use of poor children of Hornby, Claughton, Farleton, Wray, Caton and adjacent places, and that failing the supplying of Hornby and Claughton with an incumbent the money should go to Douai College for a fund for educating boys; appointing George Towneley, esq., John Serjeant of Scorton and Thomas Butler of Hornby her executors
