Richard Allen, plt., v. William John Seller, Sheriff, 1840-1, deft., in the Common Pleas. Draft case for opinion. In order to execute a fieri facias against the goods of one William Tempest, the Sheriff issued a warrant in October, 1841, for the seizure of a horse, the property of Tempest, which was in Allen's stables and was about to be disposed of by lottery. Allen, a vetinary surgeon and livery-stable keeper, claims that the horse was security for a sum owed him by Tempest. 3ff
