Whereby, having recited a 4th. Aug., 1783 agreement (wherein Jacob Leroux (in 1788 described as of Sommers P1., [St.] Pancras' pa., Mdx., esq.) undertook to notify Sir Charles Cocks (of Castleditch, Herefs., Bt.; in 1788 described as Rt. Hon. Charles, Lord Somers, Baron of Evesham, Worcs.) and (in 1788 "Hon[.]") John Sommers Cocks (in 1788 described as of Bromesherrow Place, Worcs.; Charles' eldest son and heir) if he intended to rent Bail Farm, St. Pancras pa. (forming "lot 3" - Cockses being seized of two other lots - totalling 21a.0r.1p. on the northern side of lot 2, with lot 4 (23a.2r.7p.) on lot 3's west) within the next fourteen years; if only part were to be let, it should comprise an outside section running along the land's boundary and allowing access to the rest of the ground; the lease should be for 99 years at £4 per a. for each of the first three years, and at £12 per a. p.a. for the residue of the term): therefore the Somerses let to J. Leroux lot 3's No. 5 part (280ft. long at the east and west, 290ft. at the north and south, reserving half the width of a 50-ft. roadway leading to lot 4) which abuts on the north by part of lot 3 occupied by Thomas Rhodes jun. as tenant, south by land forming lot 3's No. 6 which will also be let to Leroux, east by lot 10 which will be leased to Leroux, and west by land tenanted by T. Rhodes [jun.] which will after the sale be added to lot 3 No. 5; the plot in question covers 1a.2r.5p. and will ( reserving to the Somerses and other proprietors and lessees the use of streets which Leroux might lay, running water, and a 25-ft. roadway from Charlton Pl.) be leased for the 99 years from 25th. Mar. [, 1788] at £6/2/6 p.a. quarterly-paid with a reserved rent of £16/1/7 p.a. payable on 24th. June, 1791; Leroux will maintain whatever he shall build on the site and pay a proportion of the sanitation-costs for lots 2 and 3; the premises may be inspected at any time during the final duennium but before then only biannually with three calendar months' notice for repair; the lessee will ensure that no one shall build on the streets, and whilst he must not interrupt the flow of water he may dig for clay, etc. during the first four years upon his parts of lots 2 and 3 provided he shall use it on the premises; the lessors may re-enter if the rent become 21 days behindhand or if covenants be breached.
