Description

1. Sir Thomas Hinton of Earlescott co Wilts knt, and Dame Mary his wife, late wife of Sir Sebastian Harvey knt decd.

2. John Popham of Littlecott co Wilts esq, and Mary his wife, daughter of Sir Sebastian

3. William Pile and Gabriel Pile of Collingborne Kingston co Wilts esqres

Consideration: part performance of an order made in Chancery, 2 December 6 Charles (1630) between John Popham and Mary his wife and Sir Thomas Hinton and Mary his wife, and to settled properties on John Popham and his wife

Before Pentecost next on the manor of Greete als Great, and the advowson of the church, with appurtenances in Greet als Great, Burford, Sifton, Weston and Harthall, the manor and capital messuage of the Bower sometime in the tenure of Edward Fox gentleman in Greete and the parish of Greate, and appurtenances in Burford, Greete, Stocke, and Cayneham, and on the moiety of the manor of Henly and appurtenances (formerly the inheritance of Richard Broughton gentleman), messuages in Burford (formerly in tenures of Francis Farmor, Thomas Cherry, Barnabee Baylie and William Powell with appurtenances, parcels of land in Burford (sometime in tenure of Francis Lane), 2 pieces of land and a hopyard called Midle Dale (together 6 acres) (sometime in tenure of John Trevor) in Burford, and ½ 1b pepper payable yearly by Sir Thomas Cornewalle knt to Charles Fox, and all lands in Burford which Edward Fox esq decd formerly purchased of Francis Farmor and Thomas Cherry; 3 messuages in Whitton in the parish of Burford which were formerly conveyed to Sir Sebastian Harvye and Dame Mary, and to the heirs of Sir Sebastian by Sir Richard Hopton knight; all the manor of Whitton and lands in Whitton, Nether Whitton, Wotton, Burford, and Cayneham which Sir Sebastian purchased from Francis Whitton and Elizabeth his wife, Whorwood Whitton and Elizabeth his wife, Richard Wright and Richard Ironside; all other lands in Whitton, Nether Whitton, Wootton, Burford, Cayneham, Sifton, Weston, Nash alias Aish, Harthall, Nurton alias Overton, Bower, Stocke and Henley, and any estates of which Sir Thomas Hinton and his wife are seized for her life in her right; the manor of Orleton co Hereford and messuages and lands conveyed by indenture inrolled of 23 December 13 James I (1615)

The manor of Ludford co Hereford and the capital messuage of St Giles House in Ludford, and lands in Ludford, formerly conveyed by inrolled indenture of 11 May 16 James (1618)

The manor of Badsey co Worcs and lands in Aldington and Uffenham, conveyed to Sir Sebastian and Mary his wife by Charles Kettleby and John Kettleby esqres.

William and Gabriel Pile to stand seized to the use of John Popham and Mary for the term of their lives and the life of the survivor, then to use of John Popham his heirs and assigns, free of all incumbrances except a lease made to Joyce Cooke widow for 21 years of a messuage in Harthall under a rent of £26, made by Sir Thomas Hinton; another lease made by Sir Sebastian Harvey and Dame Mary his wife of the manor of Greet alias Great to Charles Fox, Mary his wife and Thomas his son, for the term of their lives, at a rent of £100; another lease by Sir Sebastian Harvey and Mary his wife to Richard Broughton, of the moiety of the manor of Henley for 25 years, rent £66.13.4; another lease by Sir Thomas Hinton to Edmund Fettiplace, William Digges esqres, Anthony Hinton, William Hinton, Giles Hinton, and Thomas White gentlemen, of the manors and premises in Salop for 12 years; a lease made 11 December by Sir Thomas Hinton to John Popham of the manor of Greet and the moiety of the lordship of Henley for the lives of Sir Thomas Hinton and Dame Mary his wife.

The rents of £100 and £66.13.4 reserved on leases to Charles Fox and Richard Broughton have been unpaid. Sir Thomas Hinton and Dame Mary now assign them to John Popham and appoint him attorney to take the rents
