Description

Surrender (For extinguishing leasehold terms)

(ii) to grant new lease of premises for 25 yrs. at rent of 12 guineas

(i) Hen. James Rusden, Falmouth, boot and shoe manufacturer Hen. Rusden, Falmouth, gent.

(ii) St. Hon. the Earl of Kimberley

(Recital of lease of 7 May 1838 (a) John Lord Wodehouse, Baron Wodehouse of Kimberley (b) James Richard - - ground (12p.) with 3 houses on south side of Swanpool Street.

For 99 yrs. or lives of Mary Olver Richards (then 43) wife of James Richards, Jacob Olver jun. (then 24), Eliz. Mary Brokensha (then 7). Rec. of will of James Richards of 11 December 1858. Premises left to John Barry Kelway and William Eastman on trust for testator's wife for life then income to go to Eliz. Mary Rusden, wife of Hen. James Rusden and their children) when of age. James Richards died 27 March 1861. Trustees and executors renounced; admin. went to go to wife of testator, Mary Gaved Richards, widow. Latter died at Falmouth 10 June 1871. Infant children of Eliz. M. and Hen. James Rusden 3 Oct. 1874 petitioned County Court for (i) to be apptd. trustees of will of James Richard. Court order 16 Oct. 1874 accordingly and (i) to surr. to (ii)
