Agreement : Robert Westby of the City of Westminster, esq., son of Thomas Westby, esq., and brother of John Westby of Burn, esq. decd., and Alexander Osbaldestone of Sunderland, gent, and Catherine his wife, William Shuttleworth of Turnover Hall, gent. for himself and Margaret his daughter by Bridget his late wife, Mary Westby, spinster, and John Benison, clerk, and Anne his wife, which C.B.M. and A. being daughters and only children of J.W., decd. -- capital messuage and demesne lands of Burn within Thornton, and a mansion house in Medlar cum Wesham called Mowbreck and the demesne lands belonging, and yearly rent of 53/4 from the manor of Heaton, with a windy corn mill in Medlar cum Wesham called Mowbreck Mill and tithes of corn, grain, and Hay in Wesham, and property in Much Urswick in Furnes, Kirkham, Poulton, Saint Michaels upon Wyre, and Lancaster -- to several uses, the property in Thornton and Carleton ot use of A.O, M.S., M.W., and J.B., and R.W. is not to lease any of the premises except an estate in possession of Richard Hardman of Thornton, yeoman, and one in Carleton called the Trapp, late in possession of Alexander Smithson and Adam Kellett. The other property to use of R.W. for life, then to his sons in tail male, with remainder, to A.O., M.S., M.W., and J.B. If it is thought necessary, to obtain an Act to confirm all the lands and tenements it shall be at the equal and joint expense of all the parties.
