AMENDMENT TO ASSIGNMENT

1a) William Elwalde the elder of Midleton co. York gent

1b) William Elwalde the younger, second son of 1a).

2) William Rokeby of Hotham co. York gent.

Whereas 1a), by his Indenture of 10 Mar. 1604 conveyed to 1b) his manor house etc. etc. in the tenure of 1b).

And whereas by the death of witnesses or otherwise the same estate so conveyed, for want of full proof thereof, may be questioned hereafter.

And whereas it is the intent of 1a) & 1b) to stand seised of the premises for their lives; and for that 1b is yet unmarried, if he should die living his father, 1a), could not have the premises for reason of the former conveyance but the premises would descend to the next heir of 1b) which is not intended.

Now 1a) for his fatherly love to 1b), and 1b) for his love and affection for his father, and for the settling of the premises for their two lives and afterwards on 1b)'s heirs; 1a) & 1b) grant and agree with 2) that 1a) & 1b) shall stand seised of the premises to the use of 1a) & 1b) during their lives and then to the heirs of the body of 1b); in default of such heirs, to the use of the right heirs of 1a).
