Indenture of three parts between Folliot Sandford of Bath, now only son and heir of Humphrey Sandford, and Rev. Humphrey Sandford, son and heir of Foliot Sandford, 2. The Rev. William Hopkins the younger of Fitz, clerk and Jemima his wife, before marriage Jemima Oliver 3. Thomas Tarleton the younger of Cloverley esq. and the Rev. Edward Bather of Brace Meole, clerk, trustees appointed previous to the marriage of William Hopkins and Jemima.
Whereas the manors, capital messuages, farms, hereditaments, therein described, stand charged with mortgage with the payment of 2 principal sums of £1000 and £600 with interest. Whereas by indenture of lease and release, November 22 and 23 1770, between 1. Humphrey Sandford, the grandfather and Elizabeth his wife, and Humphrey Sandford then their eldest son and heir, 2. Francis Walker esq. and Thomas Harris esq. 3. John Harris gent. 4. Thomas Ottley and Roger Kynaston & by a common recovery all capital messuages, farms, lands etc, mentioned, and intended to be granted and demised, were, amongst other uses, conveyed and assured, to the use of Humphrey Sandford the grandfather and Humphrey Sandford his eldest son for life & remainder to Isle other sons of Humphrey Sandford in tail male remainder, to the use of Folliot Sandford for natural life, to the use of Thomas Ottley and Roger Kynaston during the life of Foliot Sandford, in trust to preserve the contingent remainder to the use of the first and other sons of Foliot Sandford in tail male. Proviso in indenture of release and settlement to enable Humphrey Sandford the grandfather to charge the premises with sum not exceeding £2000 for the provisions of portions for his daughters, and younger sons by Elizabeth his wife. Power enabling Folliot (Humphrey) Sandford, when seised of immediate freehold of premises, to appoint any part to any woman he should marry for her jointure, not exceeding the yearly sum of £100, if her portion should be less than £1250. If portion should be more, then annuity from premises not more than £8 for every £100 of her portion and to chance the premises with portions to his younger children, not only £2000
Whereas Humphrey Sandford, son of Humphrey Sandford the grandfather, died unmarried and without issue in the life time of his father. Death of Humphrey Sandford the grandfather leaving Elizabeth his wife, and Foliot Sandford as eldest son and heir, incumbrance of £2000 on premises for portions of his 5 daughters. Whereas by indentures of lease and release November 14 and 15 1804, release between 1 Folliot Sandford, 2 Humphrey Sandford, 3. Richard Griffiths gent 4 Robert Pemberton gent. 5. Jonathan Scott esq, and the Rev. George Holland clerk. and by a common recovery over manors, lands, messuages farms etc. intended to be granted and demised now limited to uses and trusts declared. 1. For the ratifing the several authorities in the indenture of release of November 23 1770. powers reserved to Folliot Sandford of committing waste, and of jointing, or making provision for any wife, and raising portions for his children, and of leasing as before mentioned. And subject thereto, as to and concerning that messuage in Edgton with appurtenances now in the possession of Christopher Wilkes, at yearly rent of £140, containing 180 ac. 2 rds., 39 p. to the use of Humphrey Sandford and heirs, but subject to proviso mentioned, and as to all other manors, capital messuages, tenements etc. intended to be released after the perfecting of a common recovery, to the use of Foliot Sandford for natural life, remainder to the use of Jonathan Scott and George Holland, their executors, and administraters, for term of 1000 years, from the day of the death of Foliot Sandford, Upon trust for the raising by ways mentioned the sum of £2500 for additional portions for daughters and younger sons of Folliot Sandford and Isabella his wife, remainder to the use of Humphrey Sandford (party) and his heirs forever.
By indenture of release and settlement, November 15, 1804, agreed that Humphrey to demise messuage lands, farms etc. in occupation of Christopher Wilkes to Folliot Sandford and assigns for 99 years if Folliot so long live at rent of £150 p.a. ; done accordingly. Proviso in present indenture that Folliot, Sandford able to grant to Isabella his wife for her life, or any of children except Humphrey, sum nor exceeding £50 p.a. Whereas by articles of agreement January 11, 1811 between Humphrey 1st part, Francis Holland of Shrewsbury widow of George Holland, 2nd part, Frances Holland 3rd part, Jonathan Scott and Robert Pemberton of the 4th part, Francis Southern gent, and the Rev. William Henry Parry of 5th part, in consideration of marriage celebrated between Humphrey Sandford and Frances Holland, covenant between Humphrey Sandford and Francis Holland the elder, that when Francis Holland the younger should become 21, Humphrey Sandford should grant to Jonathan Scott and Robert Pemberton, all that messuage, farm lands etc. occupied by Christopher Wilkes, and held under lease by Foliot Sandford. To hold by Jonathan Scott and Robert Pemberton from day of decease of Humphrey Sandford for 40 years if Folliot so long lives, upon trust to permit Frances Holland the younger to receive rents and profits for life of Folliot so long lives. By same indenture, Humphrey Sandford granted to Jonathan Scott and Robert Pemberton all manors, estates of Edgton and Up Rossall for 99 years immediately following the death of Humphrey Sandford. if Folliot then dead of otherwise at his death to the intent that annuity of £580 be paid to Frances Holland daughter in lieu of dower; also that Humphrey should grant that manor and premises to Frances Southern, and William Henry Parry for 2000 years from death of survivor of Francis and Humphrey Sandford, in trust for the raising £4000 for raising of portions for daughters, and younger sons. Whereas Humphrey Sandford contracted with James Fleming Baxter of Ludlow for the purchase of tithes in the parish of Edgton with other hereditaments for £4670, but agreement not into complete execution, Whereas by virtue of indenture January 23 1810, between William Hopkins, the Reo William Hopkins, Srs William Prissick Esq. of Shrewsbury, Jemima Oliver (now Hopkins of Shrewsbury 2nd part, Thomas Tarleton and Edward Bather, 3rd in consideration of marriage to be celebrated between William Hopkins and Jemima Oliver, all real estate of Jemima Oliver to be conveyed, assured andvested in Thomas Tarleton and Edward Bather, to sell or dispose of same, upon trust with consent of William Hopkins and Jemima his wife, to place or invest the money missing in government or real securities, for the benefit of William Hopkins and Jemima his wife used. Trust estate, lately sold. Whereas Edward Bather and Thomas Tarleton, with consent of William and Jemima Hopkins, advanced to Foliot Sandford sum of £3000 and interest, on joint bond of £6000 of Humphrey and Foliot Sandford. Present indenture witnesses that Foliot and Humphrey Sandford, with consent of William and Jemima Hopkins, demised and granted to Thomas Tarleton and Edward Bather, all manors of Up Rossall and Edgton, that capital messuage with orchards, gardens, pleasure grounds' in Up Rossall. etc, formerly in possession of William Smith of 75 ac. 1r. 33 perches, and that messuage with farm lands etc. called the Isle Farm, in Up Rossall late of Edward Gittins, of 10 ac. 3rds. 15 perches, messuage called the Isle Park Farm, in occupation late of Edward Gittins now of Stephen Matthews, 228 acres 25 perches, messuage called the Isle Gate Farm in tenure of Robert Mansell, 66ac. 13 pchs. messuage with farm, in occupation of Martin Luther, 202ac. 12 perches, messuage called the Redgway, in occupation of Martin Luther, 20 ac. 1 rd. 15 perches, messuage formerly of Charles Sandford now of Christopher Wilkes, 180 ac. 2rds. 39 perches. 4 messuages with appurtenances formerly of Mrs. Mary Sandford, Christopher Wilkes and Martin Luther, in townships of Edgton, Brunslow, Hordeley, Wooleton. Also chief and other rents from estates in Edgton, Brunslow, Hordeley, Wooleton within the manor of Edgton, £1 8s. 3d. All houses, outhouses, etc. pertaining to manors, messuages etc. Also all other premises, conveyed by indentures of lease Nov. 14 and 15 1804. To have and to hold by Thomas Tarleton, and Edward Bather, for 3000 years, subject to several charges and incumbrances, subject to proviso of redemption hereafter mentioned. If Foliot or Humphrey Sandford pay to Thomas Tarleton and Edward Bather or executors £3000, with 5% interest, redemption of premises conveyed. Further that for consideration before mentioned, and for securing repayment of £3000 agreement by Humphrey Sandford to secure to Thomas Tarleton and Edward Bather all impropriate and other tithes of Edgton, within 2 months from date of present indenture, subject to proviso
