(i) William Coollen, yeoman, and wife Mary (a sister and coheir of John Parsons, yeoman);
(ii) Joan Parsons, spinster (another sister and coheir. of J. P.); and
(iii) Thomas Colley and William Whittle; all of Babcary.
[Recites: (A) That John Parsons at his death was seised in his demesne as of fee:
Mess. and 44 ac. in the par. or hamlets of Babcary or Forrington, formerly in ten. of Andrew Tilley; mess. or toft of a tenement called Strouds Bargaine, 3 closes of mdw. or past. in Stert in Babcary called Puckpitte als Pullpitte als Pokepitts cont. 36ac., and close of arable in Stert called Godds Hill cont. 20 ac. and adjoining the 3 closes, all formerly in ten. of Richard Newman; and 25 ac. in the manor and par. of Babcary comprising Broad Close Hurst (11 ac.), close adjoining on the lower side (9 ac.), Wind Hill Close (4 ac.), and 1 ac. in Furzes; all of which are since the death of John Parsons legally descended to Mary Coollen and Joan Parsons, his sisters, who stand seised of the same undivided.
(B) Agreement between the parties for the division and settlement of the property].
Covenant to levy a Fine by (i) and (ii) to (iii) to enure to uses as follows:
The mess. and 44 ac., the close adjoining lower side of Broad Close Hurst, and Wind Hill Close;
to the use of Mary Coollen for life;
and the residue of the property;
to the use of Joan Parsons for life; and after their decease, to the use of William Coollen for life. After his decease, in respect of:
The mess. formerly in ten. of Andrew Tilley, with orchard and appurts. lying southwards and divided from the other half by an old ditch called the Old Orchard; the Home Close of mdw. (8 ac.); Long Close (2 ac.); 5 rods of mdw. in Sinth Meade; 2 closes called Pennys End (10 ac.), close called Mere Meade (3 ac.); close called Pestles (8 ac.), close called Brandice (6 ac.); 2½ ac. of past. called Gibsons; Bremble Close (1 ac.); and 1½ ac. in Broad Meade; part of the above-recited property;
to the use of John Coollen, eld. son of W. C. for ever.
And in respect of:
The mess. or toft called Strodes Bargaine, the half-part of the orchard before-mentioned commonly called the New Orchard but formerly called Barly Close; 3 closes of mdw. called Puckpitts etc. (36 ac.); and close called Godds Hill (20 ac.); part of the above-recited property;
to the use of William Coollen, another son of W. C., for ever.
And in respect of:
4 ac. past. called Cary Hill, part of which is an orchard, 4 ac, of past called Stonbury, part of tenement formerly in possn. of Andrew Tilley; and the 25 ac. (Broad Close Hurst, etc.) in the manor and par. of Babcary; being the residue of the above-recited property;
to the use of Emanuel Coollen, another son of W. C. for ever.
(To hold in the subdivisions declared provided that the sd. William and Emanuel Coollen shall on the death of their father discharge certain parts of the property [named] of sums and interest due under the following:
(a) Mortgage for 1000 years, for £200, dated 14 Sep. 1674: Hugh Parsons the elder of Babcary, yeoman, and sons John and Hugh to John Hoskins of Beaminster (co. Dorset), esq.
(b) Mortgage for £100 to George Gibbs. [No further details].
(c) Mortgage for 2000 years, for £250, dated 30 Oct. 1674: H. P. and sons to William Cozens of Crewkerne, mercer.
(d) Assignment of (a) - (c) to John Foy of Bubdown (co. Dorset), gent.
(e) Mortgage for 2000 years, for £110, dated 13 Apr. 1674: H. P. and sons to William Ruddocke of East Coker, gent., decd.; with another Mortgage of the same premises.
(f) Assignment of (e) to Elizabeth Mellior of Whethull, widow).
